A driver involved in a crash that killed two young men in the Masazir settlement of Absheron 15 days ago was released just 3 days after his arrest.

Globalinfo.az reports that Naib Yusifzada, the brother of Farid Yusifzada, one of the victims killed in the crash, informed Qafqazinfo about the development.

The incident took place on the night of October 11 near Lake Duz in Masazir settlement.

A Kia Rio driven by Araz Yusif oglu Mursalli suddenly collided with an oncoming motorcycle. As a result of the violent impact, 21-year-old Allahveran Malikov, who was riding the motorcycle, and 19-year-old Farid Yusifzada, seated behind him, died at the scene. Preliminary investigations revealed that A. Malikov did not possess a driver’s license.

Following the crash, Kia Rio driver Araz Mursalli was charged under Article 263.3 of the Criminal Code (violation of traffic rules resulting in the negligent death of two or more persons), and the Absheron District Court ordered him remanded in custody as a pretrial measure.

However, the Sumgayit Court of Appeal granted the appeal filed against the decision.

Judge Elchin Mammadov concluded that the defendant had not evaded the investigation in the initial days, that no expert report was yet available, and that the circumstances of the incident had not yet been fully clarified. On these grounds, the court found no basis to keep the defendant detained. Under the new ruling, the pretrial detention ordered against Araz Mursalli was replaced with house arrest, and he was released from custody in the courtroom.

Araz Mursalli

Relatives of the young men killed in the severe road accident disagree with the latest ruling. The legal heirs of the victims are pressing charges against Araz and express indignation over his release without any reconciliation.

The preliminary investigation into the criminal case is currently ongoing. If the charges against the defendant are substantiated, he faces between 5 and 10 years in prison. House arrest is considered a direct alternative restrictive measure to detention, allowing an individual to remain free under specific conditions.
